I have been engaged in property management since 1982.  While there are times that legal action may be a necessity when dealing with tenants, the majority of the time many issues can be addressed without the necessity of legal action.   In no way should this be construed as legal advice as I am not an attorney.  However, the old saying goes,  "An ounce of prevention is worth a pound of cure."  There is no full proof method of choosing tenants.  The objective is to always minimize risk,  and to resolve issues fairly and amicably, until the point is reached where these efforts are no longer possible or productive. At this point an attorney may be required.  Like I tell all my Clients in any Real Estate Transaction:  "make sure you have an attorney,  and he is informed of what you are doing when getting into sensitive issues with tenants."  Some of the "must do" items is to background screen your tenants, request to review their tenancy history,   and credit.  There are some excellent companies that we utilize in order to facilitate this work, and we are extremely cautious about the consumer protection and privacy laws.
